What is Whistleblower Protection and its Purpose?
In 2019, the European Union adopted Directive (EU) 2019/1937 of the European Parliament and the Council of 23 October 2019 on the protection of persons who report breaches of Union law. According to this legislation, effective and comprehensive protection of whistleblowers—persons who report unlawful conduct in connection with their work—is a key element in combating corruption and an essential part of a functioning rule of law. Whistleblowers not only save public and private financial resources but can also contribute to protecting public health, saving lives, preventing ecological disasters, and more. Individual member states have implemented their respective transposition laws in connection with the directive; in the Czech Republic, this is Act No. 171/2023 Coll., on the Protection of Whistleblowers.
Protection of Individuals and Personal Data
In matters of personal data protection, as well as the protection of whistleblowers and the reported persons, procedures follow applicable legal and internal regulations. When reporting violations, whistleblowers have the right to confidentiality and further protection. The whistleblower must be identified.
Handling Reports
Depending on the content of the report, an authorized person will take appropriate steps and inform the whistleblower of the outcomes of their report, if possible. Feedback on the results of the report will be provided to the whistleblower within a reasonable period for evaluating the content and taking necessary steps.
